1. Introduction and Acceptance of Terms

Welcome to Post2Video. These Terms of Service ("Terms") govern your access to and use of the Post2Video website and services. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms.

Crucially, by using Post2Video, you also agree to be bound by the YouTube Terms of Service.

2. Description of Service

Post2Video is a SaaS platform designed to automatically convert your provided written content (including blog posts, GitHub README files, and general Markdown content) into high-quality YouTube videos. Our service automates various aspects of video production, including content parsing, video generation, and YouTube-specific details like setting titles, descriptions, tags, chapters, playlists, and direct uploading to your designated YouTube channel.

3. User Accounts

To utilize certain features of Post2Video, such as YouTube integration, you may be required to connect your Google account. You agree to provide accurate, current, and complete information as required for account setup and to maintain the security of your account credentials. You are solely responsible for all activities that occur under your account. You must notify Post2Video immediately of any unauthorized use of your account or any other breach of security.

4. User Obligations and Prohibited Uses

You agree to use Post2Video services only for lawful purposes and in accordance with these Terms. You must not:

• Upload, input, or transmit any content that is illegal, harmful, threatening, abusive, defamatory, obscene, or infringes upon any intellectual property rights or privacy rights of others.
• Attempt to gain unauthorized access to any part of the Post2Video platform, accounts, computer systems, or networks connected to the service.
• Use any automated system, including "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the Post2Video servers than a human can reasonably produce in the same period by using a conventional web browser.
• Engage in any activity that interferes with or disrupts the service or the servers and networks connected to the service.
• Use the service to generate videos for purposes that violate YouTube's policies or any applicable laws.

5. Intellectual Property Rights

• Post2Video retains all rights, title, and interest in and to the Post2Video platform, software, design, content (excluding user-provided content), and all related intellectual property rights.
• You retain all rights, title, and interest in your original written content (blog posts, READMEs, Markdown files) that you provide to Post2Video for video conversion. By using the service, you grant Post2Video a limited, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing the video conversion service to you as per your instructions.

6. Fees and Payments (if applicable)

Currently, Post2Video may offer certain features for free. Should we introduce paid features or premium plans in the future, details regarding pricing, payment terms, billing cycles, refund policies, and consequences of non-payment will be clearly communicated and may be subject to additional terms that will be incorporated into these Terms or provided separately.

7. Term and Termination

These Terms will remain in full force and effect while you use the Post2Video service. We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the service will immediately cease. You may terminate your account at any time by ceasing to use our services and, if applicable, revoking Post2Video's access via your Google account permissions.

8. Disclaimer of Warranties

Post2Video services are provided on an "AS IS" and "AS AVAILABLE" basis. Post2Video makes no warranties, expressed or implied, regarding the operation of the service or the information, content, materials, or products included on the service. To the fullest extent permissible by applicable law, Post2Video disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Your use of the service is at your sole risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POST2VIDEO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

10. Indemnification

You agree to defend, indemnify, and hold harmless Post2Video and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account; or (b) a breach of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Israel, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Haifa, Israel.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any significant changes by posting the new Terms on this page and updating the "Date of Last Update" at the top. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Post2Video has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.
